The following privacy statement is applicable to Mothernode CRM Cloud Applications and all Mothernode CRM Customers.
Mothernode, LLC. (“Mothernode” or “we” or “us” or “our”) we understand the importance of your privacy and take strict measures to ensure it is protected. This privacy policy (“Policy”) is designed to assist you in understanding how we will collect and use the information you provide when you use our cloud services and publicly accessible websites (“Sites”) and (ii) our Mothernode CRM mobile applications (e.g., Mothernode CRM for iOS®, Mothernode CRM for Android™, etc.), (“Apps”) and other related services on which we post a direct link to this privacy policy (together with Apps, the “Services”).
Our Privacy Policy includes information on how we collect, use and protect your data. Any material changes to this Policy will be announced and made available to our customers in accordance with the process described in the “Revisions or Changes” section of this Policy, below. By using our Services, you consent to our collection, use, and disclosure of your information as described in this Policy.
This Policy does not cover any other data collection or processing, including without limitation the data we host for our registered customers via the Mothernode platforms (“Platform”). If you use our Platform, the data that you (and your customers) submit as you use our Platform will be governed by the applicable Mothernode agreement, and as required by law.
Data We Collect
Depending on how you interact with our products, company, or services, you may provide us with information that can personally identify you. This information may include your name(s), street address, telephone number, email address, job title, payment card number, another financial account number (s), date and place of birth, and photographic image(s). Additionally, other information not noted above may be collected about you that by itself is not personally identifiable information but if combined with personally identifiable information could be used to personally identify you.
There are a number of scenarios by which personally identifiable information may be provided by you including when you: request customer support; register for our Platform, or register and/or set up an account/profile to access; subscribe to certain services, email notifications and/or newsletters; provide comments, reviews, feedback, or testimonials about our products or Services; visit and/or use certain portions of our Sites; complete a survey; download an electronic publication from our Sites; make a purchase; enter sweepstakes or contest; apply for a job via the Sites; and any other transactions between you and us on or in relation to our Services.
From time to time we may use your email and other addresses and contact information for customer support, training, on-boarding, required notifications, product and policy updates, important news, announcements, and marketing releases, but we will not use this information for anything else not described in this Policy.
Information We Automatically Collect
We automatically collect certain information about your use of our Sites and when you access our Sites whether by computer, mobile phone, or other devices. This certain information may include without limitation: IP address or other unique identifiers for your computer, mobile phone, or other devices; length of visit; page views; your mobile carrier; geographical location and IDs of your computer, mobile or other devices; bandwidth used; system and connection performance; browser type and version; operating system; and referral source. Technologies used to obtain such information include cookies and web beacons. We may also collect additional information about your mobile device when you download and use our Apps, including the hardware model, operating system and version, mobile network information, and time zone.
Data Integrity and Security
We constantly monitor our systems, which are protected using industry-standard technologies and security protocols. Although Mothernode will use reasonable efforts to secure network communications and our Sites, we cannot guarantee that the information submitted to, maintained on, or transmitted from our systems will be completely secure. We use reasonable and diligent efforts to maintain accurate information on our customers and have adopted and implemented reasonable industry-standard security procedures to protect any such information collected.
Access to Customer Information; Updating Customer Information. A customer may (i) access any of their personally identifiable information that we collect and maintain, or (ii) correct, update, or delete their personally identifiable information maintained by us, in each case by contacting us by telephone or mail using the contact information provided below. We reserve the right to take reasonable steps to verify a customer’s identity prior to granting access to or processing changes or corrections to such information, in an effort to protect customer privacy and security. We will try and respond to your request promptly and in all cases within 30 days. We will retain a customer’s personal information for so long as its account is active or as reasonably needed by us to provide our Services. We may also retain and use such information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
General Use of Personal Information
Mothernode may use information collected through our Sites for research regarding the effectiveness of the Sites and related marketing, advertising, and sales efforts. We may also use personally identifiable information to respond to your inquiries and/or address other requests or questions; email notifications that you have specifically requested; email marketing communications relating to our business, which we think may be of interest to you; consider and respond to your job application; provide information and updates related to your purchase; enable your use of the Services; contact you regarding your purchase; collect payments from you; send you goods or services purchased through our Sites; provide invoices; and email messages containing company news, product or service information. We may disclose your personally identifiable information (i) to the extent required by law or if we have a good-faith belief that such disclosure is necessary in order to comply with official investigations or legal proceedings initiated by governmental and/or law enforcement officials or private parties, including but not limited to: in response to subpoenas, search warrants, or court orders; (ii) if we sell or transfer all or a portion of our company’s business interests, assets, or both, or in connection with a corporate merger, consolidation, restructuring, or other company change, or (iii) as otherwise disclosed in the terms and conditions of our agreements with customers, including our separately posted and applicable Terms of Use for the relevant Services.
Requests for Information
You are not required to provide your phone number as a condition of purchasing products or Services, and you can opt-out at any time as described in the “Opting Out” section found below within this Policy. However, if you provided your email address or phone number on the Sites to receive information from Mothernode, you agree that Mothernode and our fulfillment partners may contact you using the contact information you provided us regarding our products and services, such as offers, support, and product updates. Mothernode and our fulfillment partners may make such contact by email, phone, and/or text, including the phone number you provided us, and we may use automated dialer technology in order to more efficiently connect you with one of our representatives.
Email
We may use email to communicate information to a customer regarding new products, important news, or information about Services and upgrades provided by Mothernode, using the customer’s personal contact information on file in our systems.
Disclosures to Third Parties (General)
Mothernode maintains relationships with independent contractors, implementors, resellers, and business partners, such that we may disclose information collected from a customer to these partners, who have agreed to (i) hold this information in confidence, and (ii) not use it for any purpose except to carry out the services they are providing for Mothernode. Such contractors and business partners include those hosting our Services or other data; hosting customer relationship management; enabling us to send you email; managing the functionality of our Services; assisting with marketing and promotions including marketing automation; collecting delinquent accounts; customer service and other software platforms on our behalf; processing credit or other payment card payments; fulfilling and processing orders; delivering products you have ordered; and conducting background checks if you submit an application for employment.
Disclosures to Third Parties (Specific)
Mothernode maintains a number of partner programs designed to maximize our customers’ ability to use our Services and to purchase complementary products and services that may be used in tandem with our Services. Mothernode’s partnerships are all bound by confidentiality and non-disclosure agreements. Mothernode may disclose information collected from a customer to one or more trusted partners for the purpose of such partner(s) providing assistance to the customer in its use of the Services and for the purpose of marketing complementary or value-add products and services to the Customer. In each case, such trusted partner will have agreed to (i) hold this information in confidence, and (ii) not use it for any purpose except for the purposes described above.
Disclosures of Aggregate Information
Mothernode may also disclose aggregate, anonymous data based on information collected from customers. In the event of any significant changes to the manner in which your information is handled, we would notify you by notice on the Sites, or by email. Should a sale of Mothernode’s business ever occur, collected customer information may be transferred along with the sale but the information will be treated in the same manner as set forth in this Policy.
Disclosures Made by You within Interactive Areas of a Site
We are not responsible for the potential misuse by third parties of any personally identifiable information that you choose to submit in various forums, including when you post information online using a bulletin board, blog, comment, support article, discussion forum, or chat room made available on a Mothernode site or third-party site. Please note and be aware that any personally identifiable information you submit there can be read, collected, or used by other users of these forums, could be used to send you unsolicited messages, and could be potentially searchable through search engines.
Other General Policies Relating to Privacy
APIs, Third-Party Sites, and Services
Our Sites may contain links to third-party websites. Please note that the privacy and other policies of any such third-party website may differ materially from this Policy. We strongly recommend that customers review the privacy policies of any such third party prior to submitting personally identifiable information. Mothernode has no control over and is not responsible for the information practices of other websites, including those to which we may link and those which may link to us. Customers who connect Mothernode APIs to third-party services or use Mothernode integrations with third-party services should review the privacy policies of any such third parties prior to transmitting personally identifiable information or any customer data to and from such services via API or export-import. Mothernode has no control over data that is stored, used, managed, or manipulated in third-party services and is not responsible for the information practices of other companies and their services.
Data Storage, Transfer, and Retention
Mothernode stores all of your data in the United States. Mothernode also offers mobile applications, browser extensions, and other plugins or add-ons that you can install on your local computer or mobile device but the data you are accessing is hosted in the United States. Mothernode gives you the ability to export your data at any time while your subscription is active by using any of the standard exporting features within your account. You can also request a copy of your complete Mothernode database up to two times per month or up to 30-days after your subscription end date. Mothernode will make your data available to you for download within 72-hours during weekdays (not including holidays). Once your subscription is canceled you have up to 30-days to re-activate your account or request a copy of your data.
In the event Mothernode closes your account due to misuse, abuse, and violation of your terms of use, you may contact Mothernode to request a copy of your data. Mothernode will evaluate each request on a case by case basis, pursuant to our legal obligations.
If you’ve connected to any third-party applications using any of Mothernode’s APIs the permanent removal of your account may or may not remove data from your third-party connections, i.e. accounting or email marketing software.
Use of Widgets
Our Sites may include social media features, such as the Facebook® or Twitter® button and similar widgets and interactive mini-programs that run on our site (each, a Feature). Additionally, we may provide widgets on our Sites that make it possible to share information on third-party platforms, though these widgets do not store your personally identifiable information. To the extent we use these Features, they may collect your IP address, the page you are visiting on our site, and may set a cookie to enable the Feature to function properly. Social media Features and widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these Features are governed by the privacy statement of the company providing the Feature or widget.
Use of Cookies
Cookies are files that web browsers place on a computer’s hard drive and are used to indicate whether you have visited the Site previously, so when you visit our Site, our web server sends a cookie to your computer. The data collected may include how you navigate around a web page and the most commonly clicked links on a specific web page. Certain technical information, such as your browser version and operating system, are also collected. You can configure your browser to accept all cookies, reject all cookies, or notify you when a cookie is set (each browser is different, so check the “Help” menu of your browser to learn how to change your cookie preferences). We use cookies for a number of purposes, including to conduct research to improve the content and services of our Sites; keep track of preferences you specify while you are using the Services; access a customer’s account information when a customer logs into a Site, so that we can provide the customer with customized content; and to estimate and report total audience size (unique users) and traffic for our Sites.
Web Beacons
We may use web beacons (also known as clear GIFs) to access cookies and count users who visit our Sites or open our HTML-formatted email messages. Web beacons are single-pixel graphic files with a unique identifier, similar to cookies. Web beacons are embedded invisibly on web pages and emails and are stored on a user’s hard drive. You can modify your browser settings to control web beacons.
Third-Party Cookies
Our third-party ad network partners may use cookies and web beacons to help track visitor behavior, including how you interact with a Site through the use of cookies, and this collected data may include how you navigate around a web page and the most commonly clicked links on a specific web page. From time-to-time, we may also engage third parties to track and analyze non-personally identifiable usage and volume statistical information from visitors to our Sites to help us administer our Sites and improve their quality. Certain technical information, such as your browser version and operating system, may also be collected, which can help us evaluate and, if necessary, modify the relevant Site to improve its functions and subsequently improve usability for customers. None of your personally identifiable information including your name, address, or phone number, is collected through such methods.
Re-Targeting and Behavioral Targeting
We work with third-party ad network partners that may use cookies and web beacons to collect non-personally identifiable information about your activities on our Sites and other websites, such that we can provide you with targeted advertising based upon your interests. These partners either display advertising on our Sites or manage our advertising on other websites. You may opt-out of these types of cookies by visiting the Network Advertising Initiative (NAI) website at the address: http://www.networkadvertising.org/choices/. If you do decide to opt-out through the NAI website, you can still receive communications you have signed up to receive from us unless you opt-out of those by using the information in the “Opting Out” section of this Policy.
Use of Testimonials
We may select and post customer testimonials on our Services, which may contain personally identifiable information such as your name and/or the city, state, or country in which you live. We will obtain your consent prior to posting any testimonial that could fully disclose your identity. If you post such content, it will be available to other users of the Services. Your posting may also become public and we cannot prevent such information from being used in a manner that may violate this Policy or the law. If you would like us to remove or delete your name or testimonial from our Services, you may contact Mothernode using the information in the “Contact Us” section of this Policy. Note that copies of information that you have updated, modified, or deleted may remain viewable in cached and archived pages of our Sites for a period of time.
Reviews
From time to time we post customer reviews on our Sites or Services, which may contain personally identifiable information such as your name and/or the city, state, or country in which you live. When submitting your review you are granting Mothernode full rights to post your review on our Sites or Services, including all online and offline publications. If you post such content, it will be available to other users of the Sites or Services. Your posting may also become public and used by other third-party Sites and Services and we cannot prevent such information from being used in a manner that may violate this Policy or the law. If you would like us to remove your name or review from our Sites or Services, you may contact Mothernode using the information in the “Contact Us” section of this Policy. Note that copies of information that you have updated, modified, or deleted may remain viewable in cached and archived pages of our Sites for a period of time.
Governing Law; Superseding Contract Terms
By choosing to visit and interact with Mothernode, you agree that your visit and any dispute regarding the protection of your privacy during such visit is subject to this Policy and the dispute resolution provisions in our separate Terms of Use applicable to the Services relating to the dispute. Please note that to the extent a customer enters into other contractual agreements with Mothernode, the privacy terms and conditions of such agreements (including the separate Terms of Use applicable to the relevant Services) may by express reference supplement or supersede portions of this Policy.
Revisions or Changes
As Mothernode’s services and products evolve or governing laws require, Mothernode reserves the right to change this policy and other policies prospectively at any time, subject to applicable laws and regulations. Changes to this policy will be made available on Mothernode’s websites or applications. Users will be notified when new changes will be available. Regardless of later updates or changes to our Policy, we will never use the information you submit under our current Policy in a new way without first providing you an opportunity to opt-out or otherwise prevent such use.
Opting-Out
You may opt-out of receiving future promotional/marketing messages from us by submitting the opt-out request by clicking the “Unsubscribe” link found in the footer of our email messages. Please note that if you opt out of promotional/marketing messages, you may continue to receive certain communications from us, such as information about your subscription, administrative and services announcements, and/or messages about your account/profile.
European Economic Area Users Mothernode uses processes, and stores Personal Data, including your full name, business address, and email address, as necessary to effectively provide you with our legitimate services. We rely on your consent to process personal data to send promotional emails and to place cookies on your devices. In some cases, Mothernode may process personal data pursuant to legal obligations or to protect your vital interests or those of another person.
User Rights
Individuals located in the European Economic Area (EEA) have certain rights with respect to their personal information, including the right to access, correct, or delete personal data we process through your use of the Site, Software, and/or Services. EEA rights include:
You may request a report that will include the personal data we have for you and your users stored in our account. Mothernode will provide you with easy-to-read, digitally formatted documentation containing all the personal data we have on file. Mothernode will require proof of identity prior to releasing any information about your account.
You can correct or update your data at any time. You can remove personal data from Mothernode by deleting user accounts or ending your subscription and requesting immediate deletion. Otherwise, your data will automatically be purged within 30-days from the day your subscription is deactivated. Be sure to check your Mothernode Term Agreement for obligations and cancellation policies.
We only send marketing communications to users located in the EEA with your prior consent, and you may withdraw your consent at any time by clicking the “unsubscribe” link found within Mothernode emails or changing your contact preferences. Please note during the course of your subscription you will continue to receive transactional messages related to our services, even if you unsubscribe from marketing emails.
Filing a complaint with a regulator: If you’re based in the EEA and think that we haven’t complied with data protection laws, you have a right to lodge a complaint with your local supervisory authority.
